1. INTRODUCTION

These Terms & Conditions ("Terms") govern your use of the esimNB website, iOS and Android applications, customer support, and eSIM services provided by NEW ACCESS LLC, a United States limited liability company ("Company", "we", "us", or "our"). By accessing or using our services or making a purchase, you agree to be bound by these Terms.

2. SERVICES

We provide eSIM data packages through authorized suppliers. Our services include:

• Digital delivery of eSIM activation QR codes
• Temporary data usage plans for global connectivity
• Customer support for technical issues

3. USER REGISTRATION AND ACCOUNTS

3.1 Registration Requirements

• Users may register using a valid email address and one-time verification code, Sign in with Apple, or Google Sign-In
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and current information during registration
• Your use of Apple or Google sign-in is also subject to the applicable provider's terms

3.2 Account Restrictions

• Users may not create multiple accounts
• Accounts are non-transferable
• You may delete your account in the mobile app through Profile > Delete My Account, or contact support for assistance

4. ESIM SERVICES AND LIMITATIONS

4.1 Activation and Usage

• Each plan has its own installation or activation deadline shown in the product or order details. Unless a different deadline is shown, activation is generally required within 180 days of purchase
• Once activated, eSIM services are immediately available for use
• The package validity period and the event that starts it are shown in the product details and may vary by plan
• Installation credentials are sensitive and may be subject to supplier reuse or installation limits. Do not share them or delete an installed eSIM before confirming that it can be reinstalled
• The 30-day refund-request window in our Refund Policy is separate from a plan's installation, activation, or validity period

4.2 Technical Requirements

• Compatible eSIM-enabled device required
• Stable internet connection needed for activation
• We do not guarantee compatibility with all devices

4.3 Service Limitations

• Services are subject to network coverage availability
• Data speeds may vary depending on location and network conditions
• We rely on third-party network providers and cannot guarantee uninterrupted service

5. PAYMENT TERMS

5.1 Pricing and Payment

• All prices are one-time payments and exclude applicable taxes
• We accept all major payment methods as displayed at checkout
• Payments must be completed in full before service delivery
• Additional taxes, duties, or fees may apply based on your location

5.2 Currency and Billing

• Prices are displayed in the currency specified on our website
• You are responsible for any currency conversion fees charged by your payment provider

5.3 Wallet, Cashback, and Referral Credits

• Account balance may be used only to pay in full for eligible eSIM plans or eSIM top-ups offered by us. It is not a bank account, stored-value payment account, or investment
• Balance and promotional credits cannot be withdrawn, transferred to another user, or exchanged for cash, and do not earn interest
• Cashback and referral credits are promotional benefits subject to the rules shown when earned. We may change future promotional rules, but will honor credits already earned under the applicable rules
• Unauthorized or duplicate charges and processing errors are handled under our Refund Policy and applicable law

6. REFUND POLICY

Refunds are governed by our separate Refund Policy, which forms part of these Terms. Please refer to our Refund Policy for detailed information about eligibility and procedures.

7. INTELLECTUAL PROPERTY

7.1 Our Rights

• All content, trademarks, and intellectual property on our website belong to us or our licensors
• You may not reproduce, distribute, or create derivative works without written permission

7.2 Third-Party Rights

• We respect third-party intellectual property rights
• Our services utilize authorized supplier networks and technologies

8. USER CONDUCT AND RESTRICTIONS

You agree NOT to:

• Use our services for any illegal or unauthorized purpose
• Attempt to circumvent any security measures
• Reverse engineer or attempt to extract source code
• Share, resell, or redistribute eSIM services without authorization
• Use services in a way that could damage or overburden our systems
• Violate any applicable laws or regulations

9. DISCLAIMERS AND LIMITATIONS OF LIABILITY

9.1 Service Disclaimers

• Services are provided "AS IS" to the maximum extent permitted by law, without additional warranties
• We do not guarantee uninterrupted or error-free service
• We are not responsible for network coverage limitations or third-party network issues
• Device compatibility is not guaranteed

9.2 Limitation of Liability

• Our liability is limited to the amount paid for the specific service
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for losses due to device incompatibility, network issues, or user error
• Total liability shall not exceed the purchase price of the service

9.3 Third-Party Services

• We act as an intermediary for authorized suppliers
• We are not liable for third-party network performance or availability
• Any issues with underlying network services should be addressed according to the network provider's terms

9.4 Mandatory Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any warranty, remedy, liability, or other consumer right that cannot lawfully be excluded or limited in your jurisdiction.

10. DATA PROTECTION AND PRIVACY

• We process account, authentication, purchase, eSIM, wallet, referral, device, notification, usage, payment-related, and support information as described in our Privacy Policy
• Your use of the services is governed by our separate Privacy Policy, which explains our practices and your choices
• We implement appropriate security measures to protect your information

11. CUSTOMER SUPPORT

• Technical support is available through WhatsApp and email
• Support hours and response times may vary
• We provide reasonable assistance for service-related issues

12. TERMINATION

12.1 Termination by You

• You may close your account at any time through the in-app deletion feature or by contacting support
• Account deletion may permanently remove access to unused eSIMs, order history, wallet balance, and promotional credits. Download or use any needed service information before deletion
• Account deletion does not create a right to a refund beyond the Refund Policy or rights required by applicable law

12.2 Termination by Us

• We may terminate accounts for violation of these Terms
• We may discontinue services with reasonable notice

13. DISPUTE RESOLUTION

13.1 Governing Law

• These Terms are governed by the laws of the State of Wyoming, United States
• Subject to mandatory consumer laws, disputes will be subject to the jurisdiction of the courts of the State of Wyoming, United States

13.2 Arbitration

• Where permitted by applicable law, disputes shall be resolved through binding arbitration
• Arbitration will be conducted in accordance with the rules of a recognized arbitration body
• Each party bears their own arbitration costs unless otherwise determined by the arbitrator
• This section does not prevent either party from using small-claims court or exercising statutory rights that cannot be waived

14. FORCE MAJEURE

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, network outages, or supplier failures.

15. GENERAL PROVISIONS

15.1 Entire Agreement

• These Terms constitute the entire agreement between you and us
• Any modifications must be in writing and agreed upon by both parties

15.2 Severability

• If any provision is found invalid, the remainder of these Terms remain in effect

15.3 Assignment

• You may not assign your rights under these Terms
• We may assign our rights with reasonable notice

15.4 Updates to Terms

• Continued use of our services constitutes acceptance of updated Terms
